Terms of Service

These terms are an agreement between you and Corra LLC, which operates daytori (“we,” “us”). They cover your use of our website, the emails we send, and everything you post (together, the “Service”). By using the Service, you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use daytori.

1. Who can use daytori

You must be at least 13 to use daytori. If you’re under 18, a parent or guardian needs to agree to these terms for you. You can’t use daytori if we’ve previously banned you, or if the law where you live doesn’t allow it.

2. Your account

You sign in with a Google account. Your daytori account is for you alone. Don’t share it, don’t create one in someone else’s name, and don’t create extra accounts to get around a suspension or to rate the same place more than once. You’re responsible for what happens under your account, so keep your Google account secure and tell us at support.daytori@corralimited.com if you think someone else has used it.

3. What daytori is, and isn’t

daytori helps you find places to go and plan a night around them. We work hard to keep listings accurate. Even so, hours, prices, menus, availability, photos, ratings and descriptions change all the time. Some of this information comes from third parties or other users, so it can be out of date or wrong. Check anything important, such as opening hours, reservations, accessibility, dress codes and age limits, with the venue before you go.

We don’t own, run or endorse the venues we list, and we’re not part of any booking, purchase or ticket you make with them. Your dealings with a venue, a ticket seller or any other third party are between you and them.

A listing doesn’t mean a place is safe, legal for you, or right for you. Use your own judgment. Drink responsibly, don’t drink and drive, and follow the age limits for alcohol and entry where you are.

We may change, add or remove features at any time, and we don’t promise that any feature or place will stay available.

4. What you post

You own the reviews, ratings, photos, comments, plans and other content you post (“Your Content”). When you post it, you give us a worldwide, non-exclusive, royalty-free, transferable license to host, store, reproduce, display, distribute, adapt (for example, resize or crop) and publish Your Content. The license covers running and promoting the Service, including on our social media and in search results. We can sublicense it to the service providers who help us do that. When you delete Your Content, this license ends for new uses. It continues for copies that are in backups for a limited time, or that others have already shared or copied, as the Service allows.

When you make a date-night plan public, you also let other users view it and copy it as the starting point for their own plans.

You promise that:

• Your Content is yours to post, and you have permission from anyone who appears in your photos.
• Your reviews and ratings reflect your own honest, first-hand experience.
• Your Content doesn’t break these terms or the law.

We don’t endorse user content, and it doesn’t represent our views. We don’t pre-screen it, but we may review, remove or limit anything that we believe breaks these terms, or that puts daytori or other people at risk.

5. Community rules

Reviews only help anyone if they can be trusted. When you post on daytori, don’t:

• Review a place where you work, that you own, or that you’re related to. Don’t review a competitor either.
• Post a review or rating in exchange for payment, free products or discounts. Don’t offer or accept one either.
• Post a review for a place you haven’t been to, or pretend to be someone you’re not.
• Harass, threaten, bully or hate on anyone, including venue staff.
• Share other people’s private information, such as their phone number, address or photos of them taken without consent.
• Post sexual content, graphic violence, or anything that exploits or endangers minors.
• Post spam, ads, affiliate links, or content that infringes someone else’s copyright, trademark or other rights.
• Post content that’s illegal, or that encourages dangerous or illegal activity.

Honest negative reviews are welcome. These rules never limit your right to give a truthful opinion about a business.

You can report content that breaks these rules using the report option on it. We review reports and decide what to do at our discretion. That can mean removing content, limiting an account, or suspending it.

6. Suggesting spots and edits

When you suggest a new spot or an edit to a listing, you let us use, change and publish that information in any form. We check suggestions before they go live and may reject or rewrite them. Suggestions don’t earn any payment unless we’ve separately agreed to pay you in writing.

7. Using the Service fairly

You agree not to:

• Scrape, crawl or bulk-download daytori, except as a crawler that our robots.txt allows and that follows it.
• Copy our listings, guides or ratings to build a competing directory or product.
• Get around rate limits, access controls or any other security measure.
• Interfere with the Service, overload it, or introduce malware.
• Reverse engineer the Service, except where the law allows you to.
• Use daytori for anything unlawful, or to mislead people about who you are.

8. Our content

daytori, including the design, code, name and logo, and the listings, descriptions, guides and photos we create or license, belongs to us or our licensors. We give you a personal, non-commercial, revocable license to use the Service as these terms allow. Nothing else is licensed to you.

If you send us feedback or ideas, we may use them without any obligation to you.

9. Copyright complaints

If you believe something on daytori infringes your copyright, email support.daytori@corralimited.com with “Copyright” in the subject line. Include:

• the work you believe is being infringed
• the link to the material on daytori
• your contact details
• a statement that you believe in good faith that the use isn’t authorized
• a statement, under penalty of perjury, that your notice is accurate and that you’re the owner or are authorized to act for them
• your physical or electronic signature

We respond to valid notices under the Digital Millennium Copyright Act. We’ll end the accounts of repeat infringers when appropriate.

10. Third-party links and services

daytori links to venue websites, maps, ticket sellers and other services that we don’t control. Their own terms and privacy policies apply, and we aren’t responsible for them. If we earn a commission from a link, or are paid to feature a place, we’ll say so.

11. Ending your account

You can stop using daytori at any time, and you can ask us to delete your account at support.daytori@corralimited.com. We may suspend or end your access if you break these terms, if we have to by law, or if your use creates risk for daytori or other people. Where it’s reasonable, we’ll tell you why. The sections that by their nature should last after your account ends will still apply. That includes the licenses you’ve given us, the disclaimers, the limits on liability, the indemnity and the legal terms below.

12. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. That includes warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don’t warrant that the Service will be uninterrupted, error-free or secure. We also don’t warrant that any listing, rating, review or other content is accurate, complete or current.

13. Limitation of liability

To the fullest extent the law allows, Corra LLC and its owners, employees and partners won’t be liable for any indirect, incidental, special, consequential, exemplary or punitive damages. That includes lost profits, lost data, and personal injury or property damage caused by your visit to any venue. Our total liability for all claims about the Service is limited to the greater of $100 or the amount you paid us in the 12 months before the claim.

Some jurisdictions don’t allow some of these exclusions, so some of them may not apply to you. Nothing in these terms limits liability that can’t be limited by law.

14. Indemnity

If someone makes a claim against us because of Your Content, your breach of these terms, or your violation of someone else’s rights, you’ll defend and indemnify us against it. That includes reasonable legal fees.

15. Governing law and disputes

These terms are governed by the laws of the State of California and applicable U.S. federal law, without regard to conflict-of-law rules. Before filing a claim, please email support.daytori@corralimited.com so we can try to resolve it informally. Any dispute that we can’t resolve that way will be decided exclusively in the state or federal courts in Los Angeles County, California, and you and we consent to their jurisdiction. Either of us may bring a claim in small-claims court instead, if it qualifies.

16. Changes to these terms

We may update these terms from time to time. When we do, we’ll change the date at the top. If a change is material, we’ll tell you by email or with a notice on daytori before it takes effect. If you keep using the Service after the change takes effect, you accept the updated terms.

17. General

These terms and the Privacy Policy are the entire agreement between you and Corra LLC about the Service. If any part of these terms can’t be enforced, the rest still applies. If we don’t enforce a term straight away, that doesn’t mean we give up the right to enforce it later. You can’t transfer these terms to anyone else. We can transfer them as part of a merger, acquisition or sale of assets.
